1. Information about us:

a) This website is owned and operated by The Lost Love Speakeasy Ltd.
b) Registered Office: The Lost Love Speakeasy Ltd, 3 East Point High Street, Seal, Sevenoaks, United Kingdom, TN15 0EG
c) The Lost Love Speakeasy Ltd (“We/Us/Our”) is a company registered in England and Wales with company number 11796510 and VAT Number 326454111.
d) This document tells you the terms and conditions on which we will supply to you the products (“Products”) listed on our website. Please read these terms and conditions carefully before ordering any Products and tick the checkbox in the shopping basket to accept these terms and conditions. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.
e) Please understand that if you refuse to accept these terms and conditions, you will not be able to order any Products from our website.

2. Service Availability:

Our website is only intended for use by people residing in the United Kingdom of Great Britain and Northern Ireland (“Serviced Countries”). Unfortunately, we cannot accept orders from individuals outside of these Services Countries at this time, or from certain postcodes in the Scottish Highlands and Islands.

3. Your Status:

By placing an order through our site, you warrant that:
a) you are legally capable of entering into binding contracts
b) you are at least 18 years old
c) you are a resident in one of the Serviced Countries
d) you are accessing our site from that country

4. Age Verification:

a) In the UK it is illegal for:

  1. Any person under the age of 18 to buy (or to attempt to buy) alcohol for themselves or for any other person under the age of 18.
  2. An adult to buy (or to attempt to buy) alcohol for any person under the age of 18.

b) You may only purchase an alcoholic Product from us if you are:

  1. At least 18 years old.
  2. Not buying that Product for any person or persons under the age of 18.
  3. Of legal age to purchase alcohol both in the country where you place the order and the destination country.

c) Our courier is instructed to ensure our deliveries are to persons that are at least 18. If they are unsure they may ask for an appropriate ID/signature to verify age. If this is not available, the courier cannot leave the order.

5. Our products:

a) The images of Products on our website are for illustrative purposes only. Your Products may differ slightly from those as displayed on our Website.
b) The packaging of Products may also vary from as shown on our website. You are responsible for opening and inspecting the Products upon delivery and storing them correctly.
c) You are also responsible for the preparation and mixing of our Products. We accept no liability for any loss, damage or injury arising as a result of the incorrect storage, preparation or mixing of our Products.
d) Our Products include ingredients from third party suppliers who are responsible for labelling their ingredients correctly. Whilst we undertake rigorous checks in accordance with our legal obligations prior to using all third-party suppliers, in circumstances where a third party issues a product recall for whatever reason, we accept no liability for any loss, damage or injury caused by an ingredient recall or incorrect labelling.
e) Our bottled Products are prepared for us by third parties who ensure that Products are sterilised and prepared in safe, clean environments.

6. Delivery:

a) We offer delivery to all Serviced Countries.
b) Every care is taken to ensure the products arrive safely, however we cannot take responsibility for any injury or harm caused by, but not limited to, broken glass.
c) On receipt of your goods please check the items carefully and notify us immediately of any items that are damaged, incorrect or incomplete.
d) Delivery will be completed when we, or our authorised courier company, deliver the Products to the address you gave us. If no one is available at your address to take delivery, we, or our authorised courier company, will follow the delivery instructions provided to us by you, including leaving the Product in your designated ‘Safe Location’.
e) The Safe Location specified by you shall be within the area of the delivery address and shall be accessible to the courier. We will endeavour to follow any delivery instructions you provide but this cannot be guaranteed. If no Safe Location instructions are specified, the order will be left in an area that the authorised courier company considers safe.
f) The courier company may try to contact you on the telephone so that delivery can take place. The delivery driver will use the telephone number associated with your account, which may also be printed on the delivery label.
g) Our obligation to deliver the box shall be fulfilled once the courier delivers the box at the safe spot specified by you or the box is considered safe by the courier.

7. Returns/Refunds:

a) Unwanted Products may be returned (in complete, unopened state) 14 days from receiving delivery. You must contact us for authorisation before returning any items. It will be your responsibility to ensure the goods are returned unopened and in a re-saleable condition. Products returned in an un-salable condition will not be refunded. We regret we are unable to refund any carriage costs on unwanted Products.
b) Re/un-salable condition: to qualify a return as being in ‘re-salable’ condition, the Product must reach us in ‘pristine’ condition, ie. free from tampering, with no cosmetic deficiencies and all items from the Product (as specified by us) present. A Product returned to us in anything other than pristine condition will be deemed ‘un-salable’ and not eligible for a refund. ‘Un-salable’ condition includes any of the following:

  1. Rips/tears/scuffs/marks/dents to any packaging material, labels, stationary.
  2. Dents/scuffs/marks/deformities to any bottled items or bar equipment within the Product.
  3. Tamper seals on liquid bottles being broken or liquid having been removed.
  4. Items missing from the Product (such as liquid bottles, items of bar equipment or stationery).

c) Damaged and defective goods:

  1. In the event of receiving a damaged product, (for example, if the product is broken or has leaked) you can refuse signing for it.
  2. If you open the parcel and find that the product is damaged or has leaked then you will need to provide evidence in the form of photographs.
  3. Customers must provide evidence within 21 days from dispatch of your goods. After which period the product will become ineligible for a refund. Customers will need to contact and send evidence to: pharmacy@bellelivingstonespirits.com and we will assist in either issuing a full refund (including all shipping costs) or send out a replacement product.

8. Liability:

a) Customers should also be aware of the following inherent risks and warnings:

  1. Alcohol should be consumed in moderation, and never in conjunction with operating a motor vehicle or machinery.
  2. Women should not drink alcoholic beverages during pregnancy because of the risk of birth defects.
  3. Alcohol consumption may cause health problems. See Drink Aware for more details.

b) Once you have accepted delivery of the Product, we are unable to accept liability for any use of our Products including but not limited to mixing with other ingredients, or personal consumption.

10. Data use:

By purchasing a Product from us, you agree to your data being stored on a secure server and used for communications regarding The Lost Love Speakeasy Ltd, The Lost Estate Ltd and all subsidiary companies of The Lost Estate Ltd.

11. Modification of this agreement:

We reserve the right to revise the terms and conditions of this Agreement and modify it at any time. Any such revision will be binding and effective immediately upon publishing the revised Agreement on our web site. Your continued use of our site constitutes agreement to any revision of the Terms & Conditions of this Agreement.

12. Force majeure:

In the event of force majeure (defined as a failure of an event which is non-attributable to The Lost Love Speakeasy Ltd such as war (actual or threatened), terrorism (actual or threatened), pandemic, national mourning or civil commotion, we reserve our right to cancel an order without compensation to the customer.

13. Law and jurisdiction:

This Agreement shall be governed and construed in accordance with the laws of England and the Courts of London shall be the courts of exclusive jurisdiction.

14. Statutory rights:

Your statutory rights are not affected by any of the above.
